Board Meeting MINUTES

Board Members in Attendance:

Marguerite called the meeting to order at approximately 7:14pm.

Minutes

Marian Wong made a motion to approve the February 27, 2007 Minutes.  Jocelin seconded the motion, motion passed all in favor.

Violations

Two violation letters had been mailed to homeowners in the past week.  One letter concerned severe noise violations, and the second letter concerned a charcoal BBQ on a homeowner’s balcony, despite the newsletter report of a Fire Marshall’s warning about its fire risks.

Sewers

Marguerite reviewed the issues leading to the April 10, 2007 letter on the sixth sewer spill.  The objects placed down individual homeowner drains were the worst to date and directly caused a very bad sewer spill.  This letter was the most specific in details and it may finally make an impression on those responsible.

Flood Insurance

The Board discussed a major change in flood insurance policies, imposed by FEMA.  On February 21, 2007, FEMA changed our community’s status from a high risk area to a moderate risk area.  As of Feb. 21st, multi-unit complexes are not eligible for the new preferred risk policies.  Individual homeowners will need to obtain their own policies because only private policies are currently available for purchase at a huge discount from prior rates.  All Board members voted in favor of the HOA contacting an attorney regarding the HOA’s dilemma regarding flood insurance and have him provide legal counsel.  The Board discussed all considerations at length and then voted all in favor NOT to purchase flood insurance for the remainder of the year, because the FEMA restriction cannot be challenged.  The Board also voted all in favor to have Mike Doody revise the annual budget to take the excess from the flood insurance category and delegate the funds to cover the deficit in the reserves.  All materials from State Farm, the budget, and the attorney will be mailed to all homeowners as soon as completed.

Roofs

A new home had a roof leak.  Two independent contractors were consulted and after initial observations, felt that there were likely multiple causes for the leak.  Danny De la Rosa will examine the roof area this summer and determine if there are contributing factors.  If repairs are found necessary, Mark will need to contact the developer as the roof has an extended warrantee.   If any discovery is made, Danny offered to discuss his findings directly with the developer, in a helpful non-contentious manner.
