BOARD MEETING MINUTES

Board of Directors Present:

WELCOME:

A regular meeting for the Park River Oak Estates Homeowners Association was called to order at 6:00p.m. at the Clubhouse.

FIRST ORDER OF BUSINESS-APPROVAL OF MINUTES:

The minutes of the meeting held on November 4, 2007 were reviewed by the Board.  Kimerly Harbison made a motion to approve the minutes as presented.  Alvina Tzang seconded the motion.  All in favor.

The November 4, 2007 minutes will be posted on the Park River Oak Estates Homeowners Association website.

The minutes of the meeting held on October 26, 2007 were reviewed by the Board.  Kimerly Harbison made a motion to approve the minutes as presented.  Alvina Tzang seconded the motion.  All in favor.

The October 26, 2007 minutes will be posted on the Park River Oak Estates Homeowners Association website.

SECOND ORDER OF BUSINESS-DELINQUENT NOTICES/COLLECTIONS:

As of today’s date, there are three accounts that are already in collections.  One additional account has been paid in full.  Additionally, there are two accounts (hereinafter “Homeowner A” and “Homeowner B” respectively) which have been delinquent for five months, which will be sent to collections following today’s vote.

BOARD RESOLUTION:

  1. A motion was made by Alvina Tzang, seconded by Kimberly Harbison, to approve a Board Resolution to Record Notice of Delinquent Assessment, and to forward their account to collections, for Homeowner A.  Resolution approved, all in favor.
  2. A motion was made by Alvina Tzang, seconded by Kimberly Harbison, to approve a Board Resolution to Record Notice of Delinquent Assessment, and to forward their account to collections, for Homeowner B.  Resolution approved, all in favor.

THIRD ORDER OF BUSINESS-THE YEAGERS

The Yeagers have two units located within our gated community.  However, those units were never annexed in and the Yeagers have not been making any payments toward our association expenses despite the fact that they have benefited from many services within our gated community and have been asked to contribute by the Association.  The Board previously consulted with attorney Tom Fier.  Mr. Fier believes the best remedy the Association has at this point is to obtain a binding contract through legal action due to the Yeagers’ failure to comply with our requests to pay association fees.

Kimberly Harbison made a motion to turn the Yeagers’ matter over to attorney Tom Fier to pursue our legal remedies.  Specifically, Mr. Fier is authorized to send a letter of demand to the Yeagers to advise the Yeagers that their failure to respond to said letter would result in a civil lawsuit.  If and when the Yeagers fail to respond to Mr. Fier’s letter of demand, Mr. Fier is authorized by the Board to pursue all necessary legal remedies against the Yeagers.  Motion was seconded by Alvina Tzang.  All in favor.

NEXT SCHEDULED MEETING:

Tentatively scheduled for March 9, 2008 (Sunday) at noon at the Clubhouse, subject to the availability of all board members.

ADJOURNMENT:

Meeting was adjourned at 7:10p.m.
