Meeting Minutes

1. Gutter Cleaning Proposal.
We have received three bids ranging from $3,000 – $18,000. The three vendors are Bailey Boys, Squeaky Clean, and Color Pros.
Vote to approve the middle bid by Bailey Boys passed unanimously. This company specializes in gutter cleaning.
2. Security.
Marguerite has two bids for security: Allied Universal and Guardian Protection Force. Allied’s bid is very high $3788 for five patrols. Guardian is $3200 for six patrols. All require a one-year contract. We will try to negotiate with Allied Universal who have indicated an interest in our business.
Current security costs $1900 / month.
3. Renters’ Amendment.
The HOA will attempt to cap the number of renters due to lost eligibility for FHA or conventional loans for home sales, and also a State Farm insurance increase if rental number is over a certain percentage. Private flood insurance will also be affected if the renter numbers are too high.
The Adam Stirling firm is working on language for amending the CC&Rs to cap renters. The amendment should have an enforcement mechanism, including fines.
4. Renter Issues.
The CC&Rs do not allow commercial operations on the property, which is exclusively residential. There is a renter with a commercial bakery on the property. The renter paid three fines totaling $150 and then stopped paying. How should the HOA continue to pursue the fines? There are neighbor complaints for parking and noise issues.
Marguerite will have Stirling attorneys look into the definition of “commercial business,” and advise us.
A non-resident was using the pool numerous times. Ron suggests fining the owner if a renter allows the pool pass to be used by non-resident. Fine amounts will be reconsidered and raised as they are too low.
5. Verizon spray-painted marks used for digging on property.
Verizon may have an easement, or the asphalt company had PGE mark gas lines. Marguerite will call the asphalt company to see what is going on.
6. Annual meeting in November.
Sunday Nov 11th will be the annual meeting at 5:00 p.m, subject to further review.
7. Asphalt Repairs
Asphalt repairs will start in several weeks. We must confirm that Verizon will not dig up the property.

1. Yeager case.
Due to the Yeager’s alter-ego LLC company, there is a question as to which Yeager properties can be liened. The attorneys must pierce the corporate veil to lien all Yeager properties.
2. Asphalt work.
The Asphalt company will be asked to supply security to protect the pavement. Violators will pay for any damage caused to the roads.
